Privacy Policy for California Residents

This California Privacy Policy (“California Privacy Policy” or this “Privacy Policy”) supplements the information contained in Appen’s Privacy Statement (“Privacy Statement:”) and applies solely to residents of the State of California (“consumers” or “you”). We provide this notice in compliance with the California Consumer Privacy Act of 2018 as amended and its final regulations (“CCPA”) and other California privacy laws such as the California Privacy Rights Act(CPRA”). Any undefined terms in this California Privacy Policy shall have the meaning as defined in either the Privacy Statement or the applicable law. To the extent this policy conflicts with our Privacy Statement, this policy takes precedence.

Information We Collect Use, and Disclose

Appen is a business to business services company that provides business customers with machine learning training and other artificial intelligence services. We have collected and disclosed for a business purpose the following categories of personal information from consumers within the last twelve (12) months:

Examples of Personal Information that may be collected
Identifiers.
Such as your contact information, preferences and other information about your business.
Personal information categories listed in the California Customer Records statute (Cal. Civ. Code § 1798.80(e)).
Such as your name, address, and other contact information when you sign an agreement on you or your business’s behalf.
Commercial information.
Such as your contact information, preferences and other information about your business.
On premise and electronic network activity
Such as your contact information, preferences, cookies , IP addresses, personal devices data used to connect to our systems, other similar technologies, badge scans, CCTV footage and other information about you or your business.
Geolocation Data
Such as your IP address, cookies and other similar technologies.
Work or employment-related information.
Such as current or past job or work engagement history or performance evaluations.
Sensitive Personal Data.
We collect certain personal data considered “sensitive” (“sensitive personal data”) to support our legal and business activities, as permitted by law. We collect sensitive personal data as part of our employment or contractual relationship with you. Examples of sensitive personal data we may collect include government IDs, SSNs, geolocational information, account login information, racial or ethnic origin for anti-discrimination or diversity initiatives, religious or philosophical beliefs, or union membership, biometric, and health information.
Other information you voluntarily provide
Such as current or past job or work engagement history or performance evaluations.

Please note that depending on what services our customers request from us, any or all of the above categories may be accessed/collected by Appen or accessed/disclosed to service providers.

How We Share Your Personal Information

We may disclose your personal information for a business purpose to the following categories of third parties or other parties:

  • Our customers. We may share your personal information with our customers to provide them with the services they have requested from us.
  • Our affiliates. We may share your personal information with our affiliates to provide you with the services you have requested from us or to market to you.
  • Our service providers and other third parties who provide services on our behalf to help with our business activities or services. These service providers are authorized to use your Personal Information only as necessary to provide these services to us. These services may include cloud hosting services, business or technical consulting services, payment processing, marketing services, or payroll management.
  • Our business partners, alliance partners, or other third party providers that work with, or on Appen’s behalf. If you do not want us to share your Personal Information with these companies, contact us at dpo@appen.com.
  • Disclosure for Legal Reasons. We may disclose personal information when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with the law, including valid legal requests from private parties, law enforcement, or other government agencies (e.g., subpoena, summons, or court order).
  • Change of Ownership. If Appen is involved in a merger, acquisition, dissolution, or sale of all or a portion of its assets, we reserve the right to transfer your personal information. You will be notified via email and/or a prominent notice on our website of any change in ownership.
  • Any other parties to whom you or your agents authorize us to disclose.

How Do We Use Your Personal Information That We Collect?

We may use or disclose the personal information we collect for the following business purposes:

  • To perform the service for which the information is provided. For example, if you provide us with personal information for us to complete an order, we will use that information to complete that order.
  • To enforce our rights arising from any contracts entered into between our customer and us, and between our service provider and us, including for billing and collections.
  • To protect the rights, property or safety of us, our customers or others.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As may otherwise be disclosed to you when collecting your personal information or as otherwise set forth in the CCPA.

Your Data Protection Rights and Choices

The CCPA provides consumers (California residents) with specific rights regarding their personal information. This section describes your CCPA rights and explains how to exercise those rights.

Consumers have the right to request a business disclose what personal information it collects, uses, discloses and sells. Once we receive and confirm your verifiable consumer request, we will disclose to you the specific pieces of personal information we have collected from you. In that disclosure, you may also receive information that describes the following:

  • The categories of personal information that Appen has collected
  • The categories of sources from which the personal information is collected
  • The business or commercial purpose for collecting or selling (if any) personal information

Please note, where we act as a service provider on behalf of our customers, the customer would handle the response to your request.

We will deny your request to know if (i) we cannot verify your identity; (ii) the disclosure creates a substantial, articulable, and unreasonable risk to the security of your personal information, your account with us, or the security of our business’s systems or networks.  We will not disclose your Social Security number, driver’s license number or other government-issued identification number, account password, or security questions and answers.

Deletion Request Rights

You have the right to request that Appen delete all of the personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Exercising Access, Data Portability, and Deletion Rights

  • Non-Discrimination
    Appen will not discriminate against you for exercising any of your CCPA rights.
    However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels for your business. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

Exercising Access, Data Portability, and Deletion Rights

  • Do Not Track Signal
    California Business & Professions Code Section 22575(b) (as amended effective January 1, 2014) provides that California residents are entitled to know how Appen responds to "Do Not Track" browser settings. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take actions with respect to “Do Not Track” signals.
  • Shine the Light
    California Civil Code Section 1798.83, also known as the "Shine The Light" law, permits California residents to request and obtain from Appen once a year, free of charge, information about the personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year. If applicable, this information would include a list of the categories of personal information that was shared and the names and addresses of all third parties with which we shared information in the immediately preceding calendar year. How We Share Your Personal Information

We may update this Privacy Policy to reflect changes to our personal information practices. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of updating our website. Any changes will become effective when we post the revised terms. We encourage you to periodically review this page and the Privacy Statement for the latest information on our privacy practices. Your continued use of Appen products or services after any changes or revisions to this Privacy Policy shall indicate your agreement with the revised terms.
